This End User License Agreement (hereinafter, “EULA,” “License,” “Agreement” or “License Agreement”) is a legal agreement between you and HURME DESIGN OY (“Hurme”) for the use of the Font Software associated with this License Agreement. By downloading the Font Software or installing, copying, accessing or otherwise using the Font Software, you agree to be bound by this Agreement. If you do not agree to the terms of this Agreement, do not download, install or use the Font Software.

1. Definitions. “Font Software” is digital software that generates typeface and/or the designs embodied therein when used with computers and other software (hereinafter “Font Software” or “Font[s]”). The Licensed Party is the individual, company, or company purchasing this License is one (1) person using one (1) personal computer owned by (“Licensed Party” or “You”).
2. Grant of License. Upon payment in full, Hurme will grant you a non-exclusive, terminable License to use the Font Software and the designs embodied therein together with any accompanying documentation, each in accordance with the terms and conditions of this Agreement.You may install the Font Software on the number of computers identified in the Order Receipt of your purchase, each of which must be owned by the Licensed Party. Use of the Font Software on a portable computer is permitted provided that the portable computer is owned by the Licensed Party and is not used to permit use of the Font Software by more than the number of Users authorised under this Agreement.If at any time your use of the Font Software exceeds that permitted in the applicable License, you agree to immediately notify Hurme and purchase the appropriate license.
3. One Back-Up. You are permitted to make one (1) back-up copy of the Font Software for archival purposes only. Unauthorized sharing, lending, renting, sale, or other unauthorized use or misuse of the original Font Software and/or the back-up copy is a material breach of this Agreement and will result in immediate termination of this License.
4. Use by Third Parties. If you are a design consultancy, advertising agency, or purchasing this License for use by your client, You need to also purchase a license appropriate for your client’s needs. Specifically, if your client will need copies of the Font Software and use copies of the Font Software, separate from your own uses, your client must also purchase a license for their own uses.
5. No Modification or Customization. You are not permitted to alter the Font Software in any manner whatsoever. You are not authorized to make, or hire others to make, custom or derivative versions of the Font Software. You are not permitted, by way of example not limitation, to decompile, reverse engineer, disassemble, modify, alter or change the software or any associated embedding bits. You hereby acknowledge that the unauthorized modification or customization of the Font Software shall be an infringement of Hurme Design’s rights, causing significant monetary harm. If you are interested in utilizing a customized Font, contact Hurme Design for more information.
6. Exclusive Ownership. Hurme Design, its successors and assigns retain all right and title to their respective software, trademarks, copyrights and the designs embodied in the Font Software. You agree not to copy the Font Software or create derivative works based upon the Font Software and/or the design embodied in the Font Software. You hereby agree that this term is contractual in nature and that the unauthorized use of the design of the Font and/or the Font Software shall be an infringement of Hurme Design’s rights, causing irreparable harm and significant monetary damages which cannot be readily estimated. You further agree that Hurme Design shall be entitled, without the obligation of bond, to seek injunctive relief to prevent such harm.
7. Limited distribution. You are permitted to make a temporary copy of the Font Software for use by a commercial printer or service bureau solely for use in the production of your own materials. Copying and distribution to commercial printers or service bureaus is limited to those who clearly state that they are duly licensed to use the Font Software. You are further permitted to include a temporary copy the Font Software with a document solely for the purposes of facilitating your personal printing and/or viewing of the document provided that the service bureau and/or printer agrees to destroy the temporary copy of the Font Software after the use for your benefit.
8. PDF embedding. You are permitted to embed the Font Software in Adobe® Acrobat® (PDF) documents, solely for the purposes of presenting information and designs to others or for sending designs to a service bureau or printer for output or other preparation for production. You hereby agree that any PDF shall be made in a secure manner that allows only viewing and printing of the PDF, and not the editing or alteration of the content. Font Software shall be SUBSET when embedded and the PDF document shall be set as NON-EDITABLE. If you are not sure how to subset and/or create non-editable PDFs, consult the manual or publisher of the software application from which you are exporting PDFs. You are not permitted to embed the entire character set or substantially all of the character set comprising any Font that is subject to this License. Use of Font Software in PDF documents for sale or products utilizing other forms of embedding of the Font Software for sale (for example as part of a commercial product such as a design template or an electronic book or use with a mobile device) is prohibited, and requires the purchase of a special license.
9. Internet use. You are permitted to use the Font Software to make GIF, JPEG, and PNG pixel-based images for use on the Internet as part of a website design provided that the image creation is not automated or animated and the images are made personally by a Licensed User and not generated by a server, and that no embedding or other transmission of the Font Software is made possible. Embedding the Font Software in Web pages is expressly prohibited. You are not permitted to use the Font Software in connection with embedded font objects or by any other means that embed the Font Software for the purposes of displaying the Fonts on the Internet or on wireless Web browsers.
10. Restrictions. Use of the Font Software in any of the following circumstances and/or applications is NOT permitted without first obtaining the appropriate special licensing from HURME DESIGN:
    1. ALPHABET OR LETTERFORM-RELATED PRODUCTS FOR RESALE OR LETTERFORM-CREATION PRODUCTS OR DEVICES OR ON PRODUCTS FOR SALE.EMBEDDING IN SOFTWARE AND/OR IN ELECTRONIC DEVICES; ELECTRONIC BOOKS, ALL GAMING USES AND/OR DEVICES.
    2. STORING, CACHING, SERVING OR OTHERWISE PROVIDING ACCESS TO THE FONT SOFTWARE TO THIRD PARTIES VIA THE INTERNET FOR USE OR DISPLAY ON THE INTERNET, IRRESPECTIVE OF THE FORMAT OR TECHNOLOGY USED.
    3. USE IN FILM AND/OR USE IN TELEVISION OR BROADCAST VIA CABLE TELEVISION OR ON THE INTERNET AS WEBFONTS.
    4. INSTALLATION OF THE FONTS ON A SERVER FOR SERVING FONTS TO USERS.

    If you wish to use the Font Software in a manner that is restricted under this License, contact HURME DESIGN for information about special licensing.

11. Trademarks. In the event you identify the Fonts used on your products or work product, you hereby agree to identify the Font Software by name (trademark) and the owner of the trademark in any such credits. All use of the trademark associated with the Font Software inures solely to the benefit of the trademark owner. No ownership rights are granted under this License Agreement. HURME DESIGN reserves all rights not expressly granted herein.
12. Transfer of license. You are permitted to transfer this License to use the Font Software one (1) time only and only to another end user. Under no circumstances are you permitted to purchase this License for resale purposes. Upon transfer of this License, you agree that (i) You will transfer the original Font Software together with all documentation, (ii) Any such transfer is not by consignment or other indirect means, (iii) The new Licensee reads, understands and agrees with the terms of this License, and (iv) You will destroy all other copies on the Font Software and any documentation remaining in your possession. Upon transfer of the Font Software, you are not permitted to retain copies for yourself, lend or otherwise provide copies of the Font Software to commercial printers or service bureaus.
13. Warranties. HURME DESIGN will, at its sole discretion, either replace the Font Software or refund the Licensing fee in the event the Font Software does not perform substantially in accordance with the Documentation provided that any such claim is submitted within thirty (30) days of purchase of this License. To submit a claim, you must return the Font Software to HURME DESIGN or place of purchase together with a copy of your Order Receipt and certify that no copies remain in your possession or control. You expressly acknowledge and agree that use of the Font Software is at your sole risk. The Font Software and related documentation are provided “AS IS” and, except as noted herein, is without warranty of any kind and HRUME DESIGN hereby EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. HURME DESIGN DOES NOT WARRANT THAT THE OPERATION OF THE FONT SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT THE FONT SOFTWARE IS WITHOUT DEFECTS. THE FONT SOFTWARE IS NOT FAULT-TOLERANT AND IS NOT INTENDED AND WAS NOT DESIGNED OR MANUFACTURED FOR USE IN ANY CIRCUMSTANCES WHERE FAIL-SAFE OPERATION MAY BE REQUIRED. THE FONT SOFTWARE MAY NOT BE USED IN MANUFACTURING, NAVIGATION, AND CONTROL EQUIPMENT OR IN ANY OTHER CIRCUMSTANCES WHERE THE USE OR FAILURE OF THE FONT SOFTWARE COULD LEAD TO DEATH, PERSONAL INJURY, PROPERTY DAMAGE OR SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE. UNDER NO CIRCUMSTANCES SHALL HURME DESIGN BE LIABLE TO YOU OR ANY OTHER PARTY, WHETHER IN CONTRACT OR TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, FOR ANY SPECIAL, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING LOST PROFITS, SAVINGS OR BUSINESS INTERRUPTION AS A RESULT OF THE USE OF THE FONT SOFTWARE EVEN IF NOTIFIED IN ADVANCE OF SUCH POSSIBILITY. HURME DESIGN’s liability to you shall in no event exceed the refunding of the cost of the Licensing fee or replacement of the Font Software, either at HURME DESIGN’s sole discretion.
14. Other law. Some jurisdictions do not allow the exclusion or limitation of incidental, consequential or special damages, or implied warranties. ANY IMPLIED WARRANTY OR CONDITION CREATED BY LAW IS ONLY EFFECTIVE FOR THE THIRTY-DAY (30-DAY) WARRANTY PERIOD OR AS OTHERWISE REQUIRED UNDER APPLICABLE LAW. THERE ARE NO WARRANTIES OR CONDITIONS OF ANY KIND AFTER THE THIRTY-DAY (30-DAY) WARRANTY PERIOD. The exclusions noted above may not apply to you. Otherwise, and to the extent permissible by law, you agree that all implied warranties are not effective for more than thirty (30) days.
15. Termination. This License Agreement is effective as of the date of full payment for the License. This License Agreement may be terminated by you at any time by destroying the Font Software together with any printed material and any copies of the Font Software. This License Agreement may be terminated without notice if you breach and/or fail to comply with any term contained herein.
16. Governing law. You expressly agree that this Agreement shall be governed, enforced and construed in accordance with the laws of the Finland as they apply to contracts entered into and wholly performed therein and without regard to its conflict of law provisions or the conflict of law provisions of any other jurisdiction and you expressly agree that the courts most convenient to HURME DESIGN for the enforcement of its rights under law and this Agreement shall have exclusive jurisdiction for any action or proceeding arising out of or related to this Agreement and you hereby waive any defenses arising out of the choice of law or forum identified herein and expressly consent to service of process by Certified Mail, return receipt requested. You agree that any breach of this Agreement shall cause irreparable harm and that such damages cannot be estimated and that HURME DESIGN shall be entitled to seek equitable relief including, but not limited to, temporary restraining orders and preliminary injunctions, each, without the obligation of a bond. HURME DESIGN expressly reserves any and all rights.
17. Compliance with law and export restrictions. With respect to the software licensed to you under this Agreement, you agree be responsible for compliance with all laws, foreign and domestic relating to the control of exports or the transfer of technology.
18. Severability. If any provision of this Agreement is declared by a court of competent jurisdiction to be invalid, void or unenforceable, the remaining provisions of this Agreement shall continue in full force and effect, and the invalid provision shall be replaced by HURME DESIGN with a provision that most closely effects the intent of the invalid provision.
19. Entire agreement. This Agreement constitutes the entire understanding between the parties and supersedes all previous agreements, promises, representations and negotiations between the parties.
20. Headings. The captions of the sections of this License Agreement are for convenience only and shall not control or affect the meaning or construction of any of the terms or provisions of this Agreement.

This License Agreement (“Agreement” or “License”) is a legal contract between You and the HURME DESIGN Oy, a company formed under the laws of Finland (“HURME”). When You purchase a license to use the HURME font software (“Font” or “Font Software” or “Webfonts”), You are purchasing the right to use the Font(s) under the terms and conditions identified in this License. It is important that You read and understand this Agreement because it defines Your rights, the acceptable uses of HURME Webfonts, and the rights HURME reserves. If You believe Your usage or need is not addressed, or if You are unsure of any meaning of any term or condition, please contact us before You make a purchase or use the Webfonts.

Once You download and/or use the HURME Webfonts, You are confirming You understand and agree to the terms of this Agreement, and that You have the authority to bind the person or entity specified on Your Order Receipt to the terms of this Agreement. Upon payment in full, HURME grants to You a non-exclusive, non-transferable, revocable license to use the Hurme Webfonts under the following terms and conditions.

1. Definitions
   1. “Webfont” is defined as type face font software that has been created, optimized, translated or otherwise modified for use by means of transmitting via the Internet for use in the viewing of text on a website. By way of explanation, not limitation, such uses can be implemented by means of the CSS@font-face rule. Other technology or software implementations used to effect similar results may apply and such uses or methods shall be governed by this License.
   2. “Primary Domain,” “Subdomain,” “Domain”. A Primary Domain is the host name of a website’s home page (for example, not limitation: example.com; example.co.uk; example.org; user.example.com; www.example.com/~user/; etc.). A Subdomain is a subdivision of the Primary Domain (for example, not limitation: shop.example.com; support.example.com; or user.example.com; etc.). Primary Domains together with their associated Subdomains are referred to collectively and defined as “Domains”.
   3. “You”, “Your” and the “End User” are defined as and refer to a customer who has purchased a license to use the Webfonts and is responsible for creating, placing and/or managing the content on the licensed Domains. An End User shall not be defined as a distributor, reseller, dealer, sub-licensee, original equipment manufacturer (“OEM”), server administrator or other wholesale buyer, etc. Such users are not authorized under this License. If You are a designer, part of a creative agency, or otherwise acting in a similar capacity for the benefit of a third party and You will not be in control of the Webfont’s hosting environment and the content on the licensed Domains, the purchase of a Webfonts license for Your client or the end user is required. HURME Font Software products may not be distributed and/or sold to third parties without prior written consent from HURME.
2. Permitted Uses and Restrictions
   1. Implementation. The Webfonts are provided to You for use via the CSS@font-face rule. The Webfonts will be provided with HTML/CSS/Javascript files and will contain pageview tracking code, which must be retained and used on all websites that use the licensed Webfonts. You agree that You will not use the Webfonts by any other means and/or methods of storage, transmission or viewing and that You will use the Webfont files, in the format provided to You by HURME. Use of the Webfonts in alternative formats not provided by HURME is expressly prohibited.
   2. Allowed Domains. The HURME Webfonts may be used on any website that You own. However, under no circumstances are the total number of page views allowed to exceed those for which You are licensed. The total number of Licensed monthly page views is identified in the Order Receipt of Your purchase. If Your page view limit is exceeded You must increase Your Licensed page view limits. Review Order Receipt to understand which license You purchased. For the purposes of clarity, this License does not permit the Webfonts to be used in a manner that provides for the serving of the Webfonts to domains that You do not own. Regardless of whether the Webfonts are hosted on licensed Domains, the Fonts may not be served for the benefit of unlicensed Domains.
   3. Third Party Hosts. At Your option, the Webfonts may be hosted and served by a HURME-approved third party. Under such circumstances You expressly agree the terms and conditions of this License shall govern all uses of the Webfonts irrespective of any competing or contrary terms set forth by any third party hosting the Webfonts.
   4. Webfonts File Protection. You agree to take commercially reasonable measures to ensure the Webfonts are available only for the process of styling text for display on licensed Domains. At a minimum, by way of illustration not limitation, reasonable measures include (a), preventing unlicensed third-party access, i.e. hotlinking and (b), disallowing direct download of the Webfonts unrelated to the process of styling text for licensed Domains.
   5. Back-up Copies. You may make a reasonable number of copies of the Webfonts for back-up purposes only. Any copies must contain the same documentation, copyright, trademark, and other proprietary notices that appear on, in or with the Webfonts.
   6. No Modifications, No Embedding. To the extended permitted by law, under no circumstances are You permitted to copy, modify, adapt, translate, reverse engineer, decompile, disassemble, alter or attempt to discover the source code of the Webfonts or the designs embodied therein. The embedding of HURME Webfonts or the designs of the fonts thereof in other software, digital documents, applications or devices or in any other form whatsoever is prohibited.
   7. Web Usage Only. This license does not cover the use of HURME Webfonts on a desktop, laptop, or workstation computer or for any use other than as expressly permitted herein. If You wish to use the Webfonts in a manner not permitted by this license, You must secure a separate license and/or a license extension by contacting HURME directly.
   8. Limited distribution. You are permitted to make a temporary copy of the Font Software for use by a web developer or service bureau solely for use in the production of Your own materials. Copying and distribution to web developers or service bureaus is limited to those who clearly state that they are duly licensed to use the Font Software. You are further permitted to deliver a temporary copy the Font Software to a web developer or service bureau solely for the purposes of viewing of the web development of the licensed Primary Domain provided that the service bureau and/or web developer agrees to destroy the temporary copy of the Font Software after the use for Your benefit.
   9. Development environment. You may use the Web Fonts in a secure development environment controlled by You. The secure development environment must be for work specifically related to the Primary Domain specified on Your Order Receipt.
3. Rights Reserved
   1. You expressly acknowledge that the Webfonts, the designs embodied therein, the trade names and/or trademarks and copyrights associated therewith are each the exclusive property of HURME DESIGN. All rights not expressly granted under this License are reserved to HURME DESIGN.
   2. You agree that the Webfonts and the design of the Fonts embodied therein are the exclusive property of HURME and the Webfonts’ structure, organization and code are the valuable trade secrets of HURME. You acknowledge that the Webfonts are, among other means, protected under the trademark and/or copyright laws of Finland, by the trademark and/or copyright and design laws of other nations, and by international treaties. You are not permitted to regenerate or translate the Webfonts into other formats and the creation of any derivative works based upon the Webfonts or the designs embodied therein are expressly prohibited.
4. Warranties and Limitations
   1. HURME represents and warrants that the Webfonts will perform substantially in accordance with the representations made herein. To make a warranty claim, You must notify the source from which You obtained the Webfonts together with a copy of Your Order Receipt. If the Webfonts do not perform substantially in accordance with the representations, the entire and exclusive liability and remedy shall be limited to the replacement of the Webfonts or the refund of the license fee You paid for the Webfonts, either as an authorized officer of HURME may elect. HURME and its suppliers do not and cannot warrant the performance or results You may obtain by using the Webfonts.
   2. HURME EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. HURME DOES NOT WARRANT THAT THE OPERATION OF THE WEBFONTS WILL BE UNIMPEDED, UNINTERRUPTED OR ERROR-FREE, OR THAT THE WEBFONTS ARE WITHOUT DEFECTS. WITHOUT LIMITING THE FOREGOING UNDER NO CIRCUMSTANCES SHALL HURME BE LIABLE TO You OR ANY OTHER PARTY, WHETHER IN CONTRACT OR TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, FOR ANY SPECIAL, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING LOST PROFITS, LOST SAVING, LOSS OF DATA, SAVINGS OR BUSINESS INTERRUPTION AS A RESULT OF THE USE OF OR THE INABILITY TO USE THE WEBFONTS EVEN IF NOTIFIED IN ADVANCE OF SUCH POSSIBILITY.
   3. Other law, Non-Business Users Only. Some jurisdictions do not allow the exclusion or limitation of incidental, consequential or special damages, or implied warranties. Any implied warranty or other right created by law is only effective for the ninety (90) day warranty period. There are no warranties or conditions of any kind after the ninety (90) day warranty period. To the extent permissible by law, You agree that all implied warranties are not to be effective for more than thirty (30) days. The terms and conditions of this License are contractual in nature. By downloading, installing and using the Webfonts, You acknowledge that You have read, understood, and agreed to be bound by the terms and conditions of this License Agreement.
5. Termination. Any breach of the terms of this License shall be cause for immediate termination without the obligation of notice or opportunity to cure. HURME shall be entitled to seek any all remedies under law or equity, without limitation, including injunctive relief without the obligation of posting security or bond. You agree to immediately discontinue using or return or the Webfont Software to HURME and certify that no copy remains in Your possession or control.
6. Choice of Law. You expressly agree that this Agreement shall be governed by the laws of Finland as they apply to contracts wholly performed therein and without respect to its conflict of laws provisions or the conflict of laws provisions of any other jurisdiction. You expressly submit to the jurisdiction of the courts and the geographic location selected by HURME for the purposes of resolving any dispute arising under this Agreement and You expressly waive all defenses arising out of the selection of the jurisdiction and forum elected by HURME for the resolution of any dispute and agree to service of process by certified mail or by recognized courier such as FedEx or DHL. You hereby expressly agree that the application of the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded. This Agreement may only be modified in writing, signed by an authorized officer of HURME.
7. No Other Agreements. This Agreement represents the complete and exclusive statement of the agreement between You and HURME and it supersedes any proposal or prior agreement, oral or written, and any other communications relating to the subject matter of this Agreement. No variation of the terms of this Agreement or any different terms will be enforceable against HURME in the absence of an express written amendment or consent, including a written express waiver of the affected terms of this Agreement. If any provision of this Agreement is declared to be invalid, void or unenforceable, the remaining provisions of this Agreement shall continue in full force and effect, and the invalid provision shall be replaced with a provision that effects the intent of the invalid provision.
8. Compliance with Law and Export Restrictions. You agree be responsible for compliance with all laws and regulations, foreign and domestic, relating to the control of exports or the transfer of technology as they relate to Your Order Receipt and use of the Font Software.
9. Severability. If any provision of this Agreement is declared by a court of competent jurisdiction to be invalid, void or unenforceable, the remaining provisions of this Agreement shall continue in full force and effect, and the invalid provision shall be replaced by HURME with a provision that most closely affects the intent of the invalid provision.
10. Miscellaneous.
    1. This License may be amended by the written agreement of the parties. HURME expressly reserves the right to amend or modify future versions of this License Agreement at any time and without prior notification.
    2. The waiver of any obligation, term and/or condition of this Agreement shall not constitute an ongoing or permanent waiver of any obligation, term or condition of this Agreement.
    3. The numberings of the various sections are for convenience only and shall not affect or control the interpretation and enforcement of this Agreement.

This eBook and e-Publishing Agreement (hereinafter, “EULA,” “License,” “Agreement” or “License Agreement”) is a legal agreement between you and Hurme Design Oy a limited liability company formed under the laws of Finland (“HURME”) for the product, designs and software that accompany this Agreement, and is also applicable to any media, printed materials, electronic documentation, updates add-ons, web services and any other material that may be associated with the product now or in the future. By placing an order for and accepting HURME Font Software (electronic data), or by downloading the software accompanying this License, Licensee acknowledges that it has read all of the terms and conditions of this agreement, understands them, and agrees to be bound by them. If Licensee does not agree to these terms and conditions, Licensee must promptly cease download or delivery or use of the Licensed Product and return the Licensed Product and all accompanying items, if any, to HURME for a full refund of the license fee which Licensee paid for the Licensed Product, and Licensee must immediately delete any portion of the Font Software on Licensee’s computer(s). If you do not agree to the terms of this agreement, do not purchase this License, download, install, access or use the font software.

1. Grant of License ePublications & eBook. In order to use the font software under this license you are required to use obfuscated font software provided by HURME. Upon payment in full, HURME grants you a non-exclusive, terminable License to use the font software (“font[s]”) and the designs embodied therein together with any accompanying documentation, each in accordance with the terms and conditions of this license. You are permitted to embed or install the obfuscated font software for use as a publication resource within the number of ePublications or ebooks identified in the Order Receipt of your purchase. For the purposes of clarity, this Agreement permits the use of the obfuscated font software in tablet type computing devices, smart phones and other mobile devices (“devices”) using the iOS, Android, Windows, and Blackberry operating systems and such other operating systems and Devices as may be developed in the future. If you have questions as to how to obfuscate the font software contact HURME before you install the font software. The failure to obfuscate font software before installation or to use the obfuscated font software provided by HURME, if applicable, is a breach of this license. For the purposes of this license, an ebook is a digital publication, such as but not limited to, a book, magazine, newspaper or other publication, in electronic form, that incorporates, stores, embeds the licensed font software for the purposes of accessing and/or using the font software in the use and display of the publication by means of, but not limited to, an electronic device. For the purposes of this license, if an Application is required to utilize the Font Software for an eBook or ePublication, an app or App is a computer software program or application that is intended for, but limited to, use on mobile computing devices, which incorporates, stores and/or embeds the licensed obfuscated font software and during the operation of the app uses and/or displays the licensed font software. The terms of this license agreement are contractual in nature and not mere recitations. When you order fonts from HURME you are also able to purchase Desktop, Multi-User License(s), Merchandise, Enterprise and Gaming and Application (App) licenses at the same time. 2. Limitations. Use of HURME font software in any of the following circumstances, among others, without limitation, is NOT permitted without first obtaining the appropriate special licensing:
   1. ALPHABET OR LETTERFORM-RELATED PRODUCTS FOR RESALE OR LETTERFORM CREATION PRODUCTS OR DEVICES;
   2. Except as may be permitted in this license, EMBEDDING IN ALL GAMING USES AND/OR DEVICES.
   3. EMBEDDING IN SOFTWARE.
   4. STORING, CACHING, SERVING OR OTHERWISE PROVIDING ACCESS TO THE FONT SOFTWARE TO THIRD PARTIES VIA THE INTERNET FOR USE OR DISPLAY ON THE INTERNET, IRRESEPCTIVE OF THE FORMAT OR TECHNOLOGY USED.
   5. USE IN FILM, FLASH-TYPE ANIMATIONS, TELEVISION OR BROADCAST VIA CABLE TELEVISION OR ON THE INTERNET.
   6. USE OF ANY ILLUSTRATIONS EMBODIED IN THE FONT SOFTWARE ON PRODUCTS FOR RESALE WITH THE PURCHASE OF A SPECIAL LICENSE.
3. One Back-up. You are permitted to make one (1) back-up copy of the Font Software for archival purposes only. Unauthorized sharing, lending, renting, sale or other unauthorized use/misuse of the original font software and/or the back-up copy is a material breach of this license and will result in immediate Termination of this License. You are not permitted to alter the font software in any manner whatsoever. You are not permitted, by way of example not limitation, to decompile, reverse engineer, disassemble, modify, or change the software or any associated embedding bits.
4. Exclusive Ownership. HURME and the respective owner of the font software, their successors and assigns each retain all right and title to their respective software, trademarks, copyrights and the designs embodied in the Font Software. You agree not to copy the Font Software or create derivative works based upon the Font Software and/or the design of the Font embodied in the font software. You hereby agree that this term is contractual in nature and that the unauthorized use of the design of the font and the font software shall be an infringement of HURME’s or the owner of the respective rights, causing irreparable harm. You further agree that such damages cannot be readily estimated, are irreparable and that HURME or the owner of the respective fonts shall be entitled, without the obligation of a bond, to seek a temporary or permanent restraining order to prevent harm. HURME’s or the owner’s rights shall be cumulative in nature.
5. Limited Distribution. You are permitted to make a temporary copy of the Font Software for use by a commercial printer or service bureau solely for use in the production of your own materials. Copying and distribution to commercial printers or service bureaus is limited to those who state that they are licensed to use the Font Software. You are further permitted to include a temporary copy the Font Software with a document solely for the purposes of your facilitating your personal printing and/or viewing of the document.
6. Third Parties. If you are a design consultancy, advertising agency, or purchasing this license for use by or on behalf of such an entity, the ultimate end user should also purchase a License appropriate for the intended use of the font software. Specifically, if your client will use copies of the font software, your client must also purchase the required license. The license granted herein does not extend to uses by temporary employees, freelancers or independent contractors using the font software in professional environments or for other professional uses in excess of the number licensed users. Specifically, you may not make copies greater than those authorized under this license for temporary use by freelance users, temporary employees or independent contractors.
7. Special Upgrades. All commercial for-profit usage requires a Special Font License upgrade and is available for the following scenarios: Web Servers, Web to Print technologies, Webfonts, editable PDFs, PDF editing software (such as uPDF), PowerPoint, Flash, Silverlight or other non-static files or situations where the font software is embedded or subset into electronic documents that permits editing, selecting, enhancing or other modification of the text. If not licensed under this Agreement, a Special Font License is also required for ePublishing, ePub, eBooks, eZines, conversion into any kind of Scalable Vector Graphics (SVG) and unless otherwise licensed under this license, bitmap fonts, digital news media, subscription services, phones, mobile devices, pagers, MOBI, AZW, OEM Licensing, motion pictures, videos, television, DVR menus, movie trailers and credits, acknowledgements, syndication, incorporating the font software into your hardware unless licensed under this agreement, software or any other products, such as application programs, interfaces, EPOS, WEPOS, POSReady, operating systems, electronics, kiosks, LED displays or similar mediums, automotive displays, signage, alphabet products, scrapbook products or software, adhesive or rub on lettering, embroidery machines, plotters, printers, application software for broadcast graphics, such as Avid, Chyron, Harris, Vizrt, commercial merchandising and goods for sale, (such as clothing apparel and accessories), physical goods, unique branding situations, and any and all other unique or new applications or future technologies, irrespective of operating systems or platforms. Using HURME software without the appropriate license is expressly prohibited. All Special Font Licensing can only be approved, issued and administered directly from HURME. 8. PDF Embedding. PDF and Other Forms of Embedding or Internet transmission Restricted. You are permitted to embed the Font Software in Adobe Acrobat (PDF) documents, solely for the purposes of presenting information and designs to others or for sending designs to a service bureau or printer for output or other preparation for production. You hereby agree and understand that the font software shall be SUBSET when embedded and the PDF document shall be set as NON-EDITABLE. If you are not sure how to subset and create non-editable PDFs, contact Adobe or HURME. Except as may be necessary for ebook purposes under this license, you are not permitted to embed the entire character set or substantially all of the character set comprising any Font that is subject to this License. Use of Font Software in PDF documents for sale or products utilizing other forms of embedding of the Font Software for sale (for example as part of a commercial product such as a design template or an electronic book or use with a mobile device) requires the purchase of a special license. Unless expressly authorized in this License, You are not permitted to use the Font Software in connection with embedded font objects or by any other means that embed the font software for the purposes of displaying the fonts on the Internet or on wireless Web browsers or in Flash-type animations. If you wish to use the Font Software for such purposes, you must purchase a License upgrade. You are permitted to use the Fonts to make GIF, JPEG, and PNG pixel-based images for use on the Internet provided that the image creation is not automated, the images are made personally by a licensed user, and that no embedding or other transmission of the Font Software is made possible.
9. Transfer of License. You are not permitted to transfer this License without the prior written consent of HURME and if permission to transfer is granted you are not permitted to retain copies for yourself, lend or otherwise provide copies of the font software to commercial printers or service bureaus.
10. Warranties. If the HURME software product is found to be defective within 90 days of the date of delivery to the Licensee, HURME will provide suitable replacements at no charge to the Licensee, provided the Licensee can provide proof of purchase. HURME does not warrant that this product will operate with all other software products, or that it will satisfy your requirements. HURME’s entire liability to the Licensee will not extend beyond replacement of defective media or refund of the purchase price. You expressly acknowledge and agree that use of the Font Software is at your sole risk. The Font Software and related documentation are provided “AS IS” and, except as noted herein, is without warranty of any kind and HURME and its affiliated companies (together, “HURME”) hereby EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. HURME DOES NOT WARRANT THAT THE OPERATION OF THE FONT SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT THE FONT SOFTWARE IS WITHOUT DEFECTS. THE FONT SOFTWARE IS NOT FAULT-TOLERANT AND IS NOT INTENDED AND WAS NOT DESIGNED OR MANUFACTURED FOR USE IN ANY CIRCUMSTANCES WHERE FAIL-SAFE OPERATION MAY BE REQUIRED. THE FONT SOFTWARE MAY NOT BE USED IN MANUFACTURING, NAVIGATION, AND CONTROL EQUIPMENT OR IN ANY OTHER CIRCUMSTANCES WHERE THE USE OR FAILURE OF THE FONT SOFTWARE COULD LEAD TO DEATH, PERSONAL INJURY, PROPERTY DAMAGE OR SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE. UNDER NO CIRCUMSTANCES SHALL HURME BE LIABLE TO YOU OR ANY OTHER PARTY FOR ANY SPECIAL, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING LOST PROFITS, SAVINGS OR BUSINESS INTERRUPTION AS A RESULT OF THE USE OF THE FONT SOFTWARE EVEN IF NOTIFIED IN ADVANCE OF SUCH POSSIBILITY. HURME’s sole liability to you shall in no event exceed the refunding of the cost of the font software or replacement of the Font Software, either at HURME’s sole discretion.
11. Other Law. Some jurisdictions do not allow the exclusion or limitation of incidental, consequential or special damages, implied warranties or implied warranties or the ability to reverse engineer the Font Software. ANY IMPLIED WARRANTY OR CONDITION CREATED BY LAW IS ONLY EFFECTIVE FOR THE THIRTY-DAY (30-DAY) WARRANTY PERIOD. THERE ARE NO WARRANTIES OR CONDITIONS OF ANY KIND AFTER THE THIRTY-DAY (30-DAY) WARRANTY PERIOD. The exclusions noted above may not apply to you. Otherwise, and to the extent permissible by law, you agree that all implied warranties are not effective for more than thirty (30) days.
12. Updating Software. At its option, HURME may, from time to time, provide updates of this product to Licensees.
13. Termination. This License Agreement is effective as of the Date of full payment for the License. This License Agreement may be terminated by you at any time by destroying the Font Software together with any printed material and any copies of the Font Software. This Agreement will terminate automatically without notice from HURME, if the Licensee fails to comply with any provision contained herein. Upon termination of this Agreement, the Licensee must: (a) destroy all copies of the electronic data, including the copy on the disk media originally provided in this product, (b) destroy all written materials provided with this product, if any, and (c) provide HURME with written verification that the product has been destroyed.
14. Governing Law. This agreement represents the entire agreement between the HURME and Licensee. This agreement supersedes any other Standard License Agreement which may have been included with the font software or previously displayed on the HURME or its Authorised Distributors’ web sites. This agreement may only be modified by HURME in writing that expressly states that such writing is intended to modify this agreement. This License Agreement is governed by the laws of Finland. 15. Compliance with Law and Export Restrictions. You agree be responsible for compliance with all laws and regulations, foreign and domestic, relating to the control of exports or the transfer of technology as they relate to your Order Receipt and use of the Font Software.
16. Severability. If any provision of this Agreement is declared by a court of competent jurisdiction to be invalid, void or unenforceable, the remaining provisions of this Agreement shall continue in full force and effect, and the invalid provision shall be replaced by HURME with a provision that most closely affects the intent of the invalid provision.
17. Waiver. The waiver of any obligation, term and/or condition of this Agreement shall not constitute an ongoing or permanent waiver of any obligation, term or condition of this Agreement.
18. Entire Agreement. This agreement constitutes the entire understanding between the parties and supersedes all previous agreements, promises, representations and negotiations between the parties.
19. Headings. The captions of the sections of this License Agreement are for convenience only and shall not control or affect the meaning or construction of any of the terms or provisions of this Agreement.

This License Agreement (hereinafter, “EULA,” “License,” “Agreement” or “License Agreement”) is a legal agreement between you and Hurme Design Oy a limited liability company formed under the laws of Finland (“HURME”) for the product, designs and software that accompany this Agreement, and is also applicable to any media, printed materials, electronic documentation, updates add-ons, web services and any other material that may be associated with the product now or in the future. By placing an order for and accepting HURME Font Software (electronic data), or by downloading the software accompanying this License, Licensee acknowledges that it has read all of the terms and conditions of this agreement, understands them, and agrees to be bound by them. If Licensee does not agree to these terms and conditions, Licensee must promptly cease download or delivery or use of the Licensed Product and return the Licensed Product and all accompanying items, if any, to HURME for a full refund of the license fee which Licensee paid for the Licensed Product, and Licensee must immediately delete any portion of the Font Software on Licensee’s computer(s). If you do not agree to the terms of this agreement, do not purchase this License, download, install, access or use the font software.

1. Grant of License Application (App). In order to use the font software under this license you are required to use obfuscated font software provided by HURME. Upon payment in full, HURME grants you a non-exclusive, terminable License to use the font software (“font[s]”) and the designs embodied therein together with any accompanying documentation, each in accordance with the terms and conditions of this license. You are permitted to embed or install the obfuscated font software for use as a font resource within the number of Applications or Apps and on the number of mobile devices identified in the Order Receipt of your purchase. For the purposes of clarity, this Agreement permits the use of the obfuscated font software in software installed on mobile computing devices, smart phones and other mobile devices (“devices”) using the iOS, Android, Windows and Blackberry operating systems and such other operating systems and Devices as may be developed in the future. If you have questions as to how to obfuscate the font software contact HURME before you install the font software. The failure to obfuscate font software before installation or to use the obfuscated font software provided by HURME, if applicable, is a breach of this license.    7. USE OF ANY ILLUSTRATIONS EMBODIED IN THE FONT SOFTWARE ON PRODUCTS FOR RESALE WITH THE PURCHASE OF A SPECIAL LICENSE.
   8. INSTALLATION OF THE FONT SOFTWARE ON A SERVER.

This agreement supersedes any other Standard License Agreement that may have been included with the font software or previously displayed on the HURME or its Authorised Distributors’ web sites. This agreement may only be modified by HURME in writing that expressly states that such writing is intended to modify this agreement. 15. Compliance with Law and Export Restrictions. You agree be responsible for compliance with all laws and regulations, foreign and domestic, relating to the control of exports or the transfer of technology as they relate to your Order Receipt and use of the Font Software.
16. Severability. If any provision of this Agreement is declared by a court of competent jurisdiction to be invalid, void or unenforceable, the remaining provisions of this Agreement shall continue in full force and effect, and the invalid provision shall be replaced by HURME with a provision that most closely affects the intent of the invalid provision.
17. Waiver. The waiver of any obligation, term and/or condition of this Agreement shall not constitute an ongoing or permanent waiver of any obligation, term or condition of this Agreement.
18. Entire Agreement. This agreement constitutes the entire understanding between the parties and supersedes all previous agreements, promises, representations and negotiations between the parties.
19. Headings. The captions of the sections of this License Agreement are for convenience only and shall not control or affect the meaning or construction of any of the terms or provisions of this Agreement.
